How to File a Freight Damage Claim: Step-by-Step Guide

Freight damage happens. Knowing exactly what to do in the first 24 hours after discovery is the difference between a full recovery and absorbing the loss yourself.

Step 1: Document at Delivery — Before Signing Anything

This is the most critical step. When the truck arrives:

• Inspect every piece before signing the Proof of Delivery (POD)
• Photograph all damage — exterior of packaging, interior damage, pallet condition
• Note exceptions on the POD — write "damaged" or "shortage of X pieces" before signing
• Have the driver acknowledge the notation if possible

⚠️ If you sign a clean POD and discover damage later, your claim becomes significantly harder to win. Never sign clean if there's visible damage.

Step 2: Preserve the Evidence

• Keep all damaged freight — do NOT dispose of it until the claim is resolved
• Keep all original packaging
• Take additional photos of the damage in full
• Get a repair estimate or replacement cost in writing

Step 3: File the Claim Within the Deadline

This is where many shippers lose valid claims — they miss the filing deadline.

Carrier Liability Limits

Under the Carmack Amendment, carriers are liable for the actual loss or damage to freight. However, many carriers limit liability through tariff rules — commonly $0.10–$2.00 per pound depending on commodity. For high-value freight, always arrange additional cargo insurance before the load moves.
